Architect, Engineer, Real Estate Appraisal & Land Surveying Services:
Those professional services within the scope of the practice of architecture, professional engineering, real estate appraisal or land surveying, as defined by the laws of this State.


Business:
Any corporation, partnership, individual, sole proprietorship, joint stock company, joint venture, or any other private legal entity.

Bond, Bid Bond:
Guarantees contractor will complete the scope of the contract in accordance with the terms and conditions.

Bond, Performance Bond:
Guarantees contractor will complete the scope of the contract in accordance with the terms and conditions.

Bond, Labor and Material Payment Bond:
Guarantees that subcontractors of the prime will be paid for labor and materials.


Construction:
The process of building, altering, repairing, improving, or demolishing any public structure or building, or other public improvements of any kind to any public real property. It does not include the routine operation, routine repair, or routine maintenance of existing structures, buildings, or real property.

Contract:
All types of Unified Government agreements, regardless of what they may be called, for the procurement or disposal of supplies, services, or construction.

Cooperative Purchasing:
Procurement conducted by, or on behalf of, more than one Public Procurement Unit, or by a Public Procurement Unit with an External Procurement Activity.


Invitation for Bids:
All documents, whether attached or incorporated by reference, utilized for soliciting bids.


Local Business Enterprises (LBE):
means businesses headquartered or that maintain a major branch that performs the significant functions of the business in Wyandotte County, Kansas, or businesses of which at least 51% of the stock, equity or beneficial interest is owned, held, or controlled and whose day-to-day management is under the control of an individual residing in Wyandotte County, Kansas. There is no certification process for LBE. This status is determined by the address information listed in your registration.


Minority Business Enterprise (MBE)*:
Any business/enterprise that is at least 51 percent owned by, or in the case of a publicly owned business at least 51 percent of the stock is owned by, citizens or permanent resident aliens who are:

  • Black persons having origins in any of the black African racial groups not of Hispanic origin;
  • Hispanic persons of Mexican, Puerto Rican, Dominican, Cuban, Central or South American descent of either Indian or Hispanic origin, regardless of race;
  • Asian and Pacific Islander persons having origins in any of the Far East countries, Southeast Asia, the Indian subcontinent or the Pacific Islands; or
  • Native American or Alaskan native persons having origins in any of the original peoples of North America,

Woman Business Enterprise (WBE)*:
Any business/enterprise that is at least 51 percent owned by, or in the case of a publicly owned business at least 51 percent of the stock is owned by, citizens or permanent resident aliens who are women.

* Note: A firm must be certified by one of the following agencies to be recognized as an MWBE by the Unified Government; however, lack of certification does not preclude a firm from doing business with the Unified Government:


Request for Proposals:
All documents, whether attached or incorporated by reference, utilized for soliciting proposals.

Responsive Bidder:
A person who has submitted a bid, which conforms in all material respects to the Invitation for Bids.


Specification:
Any description of the physical or functional characteristics, or of the nature of a supply, service, or construction item. It may include a description of any requirement for inspecting, testing, or preparing a supply, service, or construction item for delivery.

Supplies:
All property, including but not limited to equipment, materials, printing, insurance, and leases of real property, excluding land or a permanent interest in land.

Sole Source Procurement:
A contract may be awarded for a supply, service, or construction item without competition when, under regulations promulgated by the Unified Government Administrator, the Purchasing Director after conducting a good faith review of available sources determines in writing that there is only one source for the required supply, service, service, or construction item.
